White House removes protections for endangered species

With just over a month remaining in office, the Bush administration loosened federal protection of plant and animal species threatened with extinction.

On Thursday, the Interior Department announced a change to Section 7 of the Endangered Species Act, which required federal agencies to consult with scientists at the Fish and Wildlife Service or the National Marine Fisheries Service to determine whether a project is likely to affect any listed species.

Under the new rule, federal agencies such as the Federal Highway Administration can in many cases simply check with their own personnel to determine if their activities will harm any of the 1,247  animal and 747 plant species listed as endangered or threatened.

“The rule strengthens the regulations so the government can focus on protecting endangered species as it strives to rebuild the American economy,” said Secretary of the Interior Dirk Kempthorne.

It started with the polar bears

The rule change has its origins in a May announcement by the Interior Department that listed the polar bear as threatened because global warming is melting its habitat. It was the first animal to be listed because of climate change.

In that announcement, Interior Secretary Dirk Kempthorne said that even though global climate change is the reason that the bear is on the endangered species list in the first place, that list is “not the means, nor the method, nor the vehicle by which you can deal with global climate change.”

The Interior Department’s press release cites a May editorial from the Washington Post that endorses this view:

That Mr. Kempthorne has to contort his agency to ensure that it doesn’t get dragged into setting US climate policy is simply more proof of the need for such a policy, supported by the White House and ratified by Congress, that aims at sharply reducing greenhouse-gas emissions. Though the polar bear deserves protection, the Endangered Species Act is not the means and the Fish and Wildlife Service is not the agency to arrest global warming.

The release quotes the second sentence of that paragraph.

So under the new rules, federal agencies that are undertaking a project need not check with Fish and Wildlife or National Marine Fisheries under these circumstances:

1. Where the action has no effect on a listed species or critical habitat, or
2. Where the action is wholly beneficial, or
3. Where the effects of the action can not be measured or detected in a manner that permits meaningful evaluation using the best available science, or
4. Where the effects of the action are the result of global processes and can not be reliably predicted or measured on the scale of species current range, or would result in an insignificant impact to a listed species, or are such that the potential risk of harm to a species is remote.

    Reactions

    Environmentalists are less than thrilled by this rule change. Andrew Wetzler, director of the Natural Resources Defense Council’s Endangered Species Program, says his organization will probably sue:

    “This administration has rejected anything with a whiff of science – so before sulking out the back door, they are going after rules that require Fish and Wildlife Service scientists to prevent harm to our last wild animals and places. Despite today’s feel-good statements, we remain convinced that these changes are illegal. We will look at the final language when it is published tomorrow, but I think we will see them in court.”

    Defenders of the Wildlife, who have filed suit along with Greenpeace and the Center for Biological Diversity, are similarly disgusted by the Bush administration’s actions:

    “This administration’s disdain for wildlife and the environment has never been more clear than it is today,” said Jamie Rappaport Clark, executive vice president of Defenders of Wildlife and former director of the Fish and Wildlife Service. “For 35 years, the Endangered Species Act has helped save and recover imperiled wildlife on the brink of extinction. Now, with this administration facing its last days, they are doing everything they can to cement their anti-environmental legacy before the Obama administration takes office.”

    The US Chamber of Commerce welcomed the rule change.

    Reversible?

    Obama says that he intends to reverse the rule change, along with other “midnight rules” made in the waning days of the Bush presidency. But that may be easier said than done.

    ProPublica, a nonprofit investigative news organization, notes that while last-minute rules that have not yet taken effect can be quickly reversed by Obama’s appointees or by executive order, rules that are in force when he takes office cannot:

    Rescinding a rule would require the new administration to restart the rulemaking process, which can take years and prompt legal challenges. Another strategy that has been talked about lately – getting Congress to disapprove the rules through the Congressional Review Act – carries political risks and has been used only once before.

    The new endangered species rule takes effect nine days before Obama’s inauguration.

    There is still a chance that the rule could be quickly reversed, however. USA Today reports that Rep. Nick Rahall (D) of West Virginia, the chairman of the House Natural Resources Committee, says that he will likely invoke the Congressional Review Act, a rarely used law that gives Congress 60 days to review and overrule regulations issued by government agencies.

    Tired of tree hugging kooks like Al Gore, I am. They never tell you that the south pole has been getting larger, or that the last year was getting overall colder, not warming! This year looks to be the same. They never tell you that when one big volcanic eruption goes off like Mt. St. Helens it throws more “so called” green house gases into the air than all of man does for a decade or so. There are volcanic emissions going on constantly, under the sea too. They never mention sunspot activity, no, only what suits their agenda of controlling your life and higher taxes because of the evil demonic oil and coal industry. Heck even cows and their **** are evil too. Can you eejits, I can. Oh yeah we cant have nuclear or build hydro electric dams because the rare spotted fire ant fish might be affected by the dam. The new energy efficient light bulbs they want to make mandatory have mercury in them where the old incandescent did not. They say if you break one in your house it is a bio hazard, you have got to be joking, yet these people back them. Wake up America and don’t let the left take over or we will be screwed.

Yes, the bear is on the list because their habitat is melting but where are these supposed new policies for climate change that they are talking about? Sorry, Im just confused with the connection between saving a species and making global climate change policies. Which, there really havent been any policies made anyway so why the worry?

    Freedom to do whatever you want is not a panacea to the world. There is such a thing as common sense and intelligence. There is a point where your freedoms impinge or indeed counter those of others. Somehow Bush does not get it. He is a simpleton.

    Thank God for the Obama administration. It will, somehow, put things right. Talk about elite, smart a** stuff. Bush’ legacy has been cemented in stone. He is a cave man, an illiterate, perhaps even a fool. He is backward thinking if he thinks at all. His entire being is somehow profoundly handicapped, in my humble opinion.     We share this world with other living creatures and this symbiotic relationship has endured for many ages. This is an important consideration when we humans walk about destroying nature for selfish and gluttonous aims.

    I for one am not a “tree hugger” on the contrary I firmly believed in evolutionary principles. The human species is on excluded from the forces of evolution either. We have our next wars over resources soon, the living ecological systems decade and what had support us for so long leaves and we as a species die – walking in the foot steps of dinosaurs.

    However, I propose exploring the possibilities of science for science sake not using the Edison model of “any science worth selling is the only good science.” We need to begin exploring and building on the planets we can reach with out current technologies. This serves two purposes:

    1. In the event we succeed and destroy our home planet we have another “place to live.

    2. Upon those new worlds (Moon or Mars), we will find we humans have much more in common and begin working “collectively” for our total survival and actively look for another Earth to populate.

    If history is any type of indicator of future potential, I am confident Humans will become a nice addition to the next species- that emerges from the shattered of Earth- museum. We would make a nice exhibit, with fast food, over weight bodies and those cell phones stuck to the side of our skulls.

    I’m a tree hugger I guess, I LIVE IN THE WILDS of Alaska.
    Those commenting? its called climate change. Not global warming, and simple logic works, that as the ocean temps raise (oh, 90% dead now, and there goes a lot of jobs with that too), so too does the evaporation rate increase on the ocean surface, causing more clouds, which reflect more light, AND thus altered, also alter the weather patterns.
    Its not about over emotional environment fanatics, its about math, you kill off all life on earth and OPPPS humans are ALIVE too!
    Its a co-dependent habitat, you cant destroy IT without destroying US.
    If you want to destroy all life, go to another planet were there is no life, leave this one, please do.
    Al Gore’s response was to math, those ice core samples compared to the current CO2 concentrations and if you get that info, if your not scared stiff, you should go seek professional help.
    Protecting this earth, is also about protecting a way of life, yours is included. If all life on this planet is wiped out, not much else will matter including your paychecks. Or jobs that could be gained spending money to buy wind generators and the money you would save if you had one or more, STAYING in our country and economy instead of going to other countries into the hands of those who already have an abundance.     I’ve been studying climatology 35+ years, using wind and solar power as many years (right after I started seeing myself whats going on).
    We are going to run out of oil, why wait until its all gone to change? Why wipe out life on earth, rather than change before nothing is left for the next generation?
    Me divided by world population divided by 100 (time for earth to produce oil), equals 1.88 barrels my lifetime, after that I’m stealing from my children.

    It’s funny. Our current president is reportedly set to create a vast nature preserve out in the South Pacific but now derails the regulatory process that would otherwise serve as a protective check for environmental harm in the Arctic portion of Alaska. Oh! Did I say Alaska as in north slope, as in oil reserves? Gee do you think Mr. Bush might be extending a helping hand to his friends in the oil industry? Because I am willing to bet that any oil and gas exploration would require an environmental impact analysis that would have to include the impact on endangered species. But then again, the polar bears are going to be gone when the ice cap melts so why worry. Sarah Palin can go shoot a bunch of bears and start stockpiling the skins as collector items for when there are no more polar bears! And for the gents still dissing the environmentalists as fear mongers, get a grip boys. Climate change is here and will be THE issue for this century.     I wish President Bush would visit a nature preserve. It seems like he lacks an appreciation for nature. To me it seems that global warming (or climate change if you insist) is here. Last summer I saw water spouts in cold springs harbor, which struck me as odd. For those who agree with me. I would encourage them to challenge “global warming deniers” on whether or not they have actually seen “an inconvenient truth.” I’ve found that those who discount it haven’t even watched the video. They use outdated theories that have been clearly discredited by modern science experiments. They simply don’t want to believe. Encourage them to watch.

    Furthermore, we have a choice to make. We can deal with this problem or not deal with this problem. Ignoring it will not make this problem go away, and will only drag america into a slow death. The places where we get our oil from are extremely unstable. That makes our existence unstable. I hope we deal with this significant problem.

    How could anyone look into the soulful eyes of that polar bear, admire the soft white fur that keeps her warm, ponder the fate of the cubs she is probably struggling to feed — and NOT want to protect her entire species?

    Only those with pinched hearts and addled minds could possibly believe that humans “come first.” We humans are not here to compete with and beat out other species, but to learn how to live cooperatively and magnanimously with all beings.

    President Bush has been listening to his “me first” cronies for the last eight years. These industrialists and industry puppets don’t seem to get that the world’s economy and the world’s environment are inter-dependent entities whose successes are tied to each other, not opposed to one another.

    I trust President-Elect Obama understands that adopting a “you first” approach — especially toward the “yous” who are completely vulnerable and helpless (which certainly includes all animals) — is the only way to solve the complex problems facing mankind, including global warming and species extinction.

    May the “you first” way — the royal way, taken by the child whose birth many of us will celebrate in a few days — win the right of way in the next Administration and beyond.

    P.S. That child, when he grew to manhood, forgave many for their misdeeds, but he didn’t give hypocrites any slack!

    Some of these posts are interesting.. such as “down with tree huggers”. Just what exactly will Americans do once we’ve logged everything? This isn’t about owls/bears… it’s about our long term survival and the survival of our children. Animals are only the symptom… Save the earth to save the humans! If all the animals are dead.. how much longer do you think it will take for us to die off?

    But really, it’s going to take us to make real change happen. Obviously government is not our savior. Now regular geniuses can apply (change.gov), but as of now, we don’t have the best and brightest in government… just those with the best lobbyists running this country. Let’s keep it grass roots, so real change can happen.

Other species have a right to simply live, as a Mirror of the Divine creator of this Planet and Universe.     It is a strong, yet fragile Creation meant to sustain life.

    Human beings like Bush have proven themselves to be the most idiotic and destructive of our species. They support a philosophy of Pillage first and throw your hands up in the air later when the Destruction is done. What happened. How did things get SO polluted? How did the Whales almost disappear in parts of the Ocean (before the Endangered Species Act)?
    Why are the fish deformed over here, the frogs disappearing over there?, The Polar Bears up there???AND so ON! And why is there so much CAncer and anxiety-caused illnesses in Americans. Gee, WHY IS THAT??

    I don’t want to adapt to a world that has systematically killed off the higher life forms of this planet. Any species is more innately intelligent than people who measure a making a BUCK against the choice of ravaging the living Earth and her wonderful inhabitants any further. THis Country has a wealth of greatness and would be the wealthiest, indeed, by caring for our wildlife and air, land and water.
    This gutting of the Endangered Species Act is one more example of people hating living beings and it must be because they hate themselves so much inside, and so they destruct others.

    Take your child to Park, a Nature preserve, the Ocean. They know just what to do, marvel and love it and explore it. They will want to be in it with it, of it. It makes them alive and sane and so very happy inside.
    That’s until you have to tell them not to wade in the water because there is so much polution in it OR there are no more whales or condors or wolves, etc. in the wild.
    Find your own child-self inside and find out if it still has the ability to LOVE life.

    We are mere Stewards of this planet, in case you didn’t know that. We don’t own it!!!

    WE DO NOT WANT THE BUSH LEGACY TO DESTRROY THE ONLY PROTECTION THAT TROUBLED SPECIES ON THE VERGE OF EXTINCTION HAVE.     Get your feet in the Ocean (if it’s not too polluted) marvel at the life forms in PArks, Forests, Wetlands or even your backyards. Life wants to thrive. Surely you can identify with that feeling. If not, you have lost your own ability to understand life.
    That is the trajedy of many humans.
    We don’t want that trajedy to progress ANY further.

    I can’t believe that anybody could think that a job is more important than trying to stop what we are doing to the planet. Going green would make more jobs, and to be honest, if your life is about work and buisnesses and communting thousands of miles then one day you’ll tkae a look at your life and gop ‘oh ****, what have i speant my life doing?’.

    Yes, indeed, Bill (#21), the founder of this newspaper certainly did apply the “injure no man” motto to animals.

    Though it was not her specific mission to reform humanity’s treatment of animals, she did write in her textbook, Science and Health, that “The individuality created by God is not carnivorous…” (p. 514) and that “God gives the lesser idea of Himself for a link to the greater, and in return, the higher always protects the lower” (p. 518).

    In her Message for 1901, she said, “Christian Science gives neither moral right nor might to harm either man or beast.”

    Yes, people do come first and because of this we have to care for our environment otherwise there won’t be people - well not living in any sort of conditions of quality. Some of the anti-environmentalists on these postings don’t seem to understand cause and effect. People are at plague proportions and all of them want their SUV’s and air conditioners. Multiply that by the growing global population and disaster will follow for sure. To me there are stark similarities between the excesses of the lending and financial industries that recently caused this massive economic collapse we’re in, and the pending environmental collapse that is coming. You only have to look back a few months and people like Bernake and others were understating the severity of the economic situation. And today we hear so many people still in denial of the environmental situation. One thing they fail to realise is that the sooner we face this enormous problem, more jobs will be produced not less. As for the Bush administration - pathetic beyond words. More than shoes needs to be thrown at him and his ilk!

    From the DOI brief:
    “Contrary to published reports, nothing in this regulation requires that a Federal agency bypass informal consultation, nor does the regulation preclude any Federal agency from seeking the expertise of the U.S. Fish and Wildlife Service and the National Marine Fisheries Service or from taking advantage of expertise that may be available from State and local agencies, universities, non-governmental organizations or other sources.”

    “Additionally, nothing in this regulation relieves an action agency of its responsibilities to ensure that listed species are not harmed during the completion of the Federal action, regardless of whether consultation is undertaken or not. In such cases where an action agency determines that consultation is not required and harm to a listed species results from that agency’s actions, full civil and criminal penalties, as laid out under other sections of ESA, remain in effect.”

    “With the regulations finalized today, federal agencies must still follow all existing consultation procedures, except in specific and limited instances where an action is not anticipated to adversely impact any member of a listed species AND that action fulfills one of the following criteria:

    It seems like most of the posters here prefer to remain ignorant and hate the Bush because it’s the in thing to do. The idea that the environmental regulatory process has been “derailed” is ridicules and coming from those who have never had to deal with it.

    I could, because the bear is looking into my soulful eyes and thinking I’d be a great meal for her cubs.

    While the fish and wildlife service has the scientists and expertise to determine whether or not endangered species are at risk from federal projects, it should not have the power to block said projects when there is no effect on a species. Blocking the building of a highway in Arkansas because the emissions will melt the polar ice caps and shrink polar bear habitats makes absolutely no sense. This clears up red tape in federal project development. Whether or not the implications are sinister has to be judged on a case by case basis IMO. I rarely ever defend the Bush Administration, but he has pushed through various other last minute laws that deserve a lot more outrage.

    I could rant about Bush. I could tell Glenn to check some facts. I could tell frank that both can be done. But I won’t. I agree with Olivia, and I think the best evidence that this is wrong is the the splashing of paws when a polar bear drowns. The cry of a polar bear cub when its mother doesn’t come back. This is the reason. This is why we care. Animals have emotions too, and I hope this is as hopeless as they’ll ever feel.
